Minutes of the City Council Meeting held at 5:00 p.m. on Tuesday, December 11, 2018, in the Kitty Young Council Chamber at the Harker Heights City Hall at 305 Miller’s Crossing, Harker Heights, Texas 76548:

Consent Items:

1. Council discussed and considered approving the minutes of the meeting held on November 13, 2018. Reider made the motion to approve as presented. Seconded by Blomquist. All in favor. Motion approved by 4-0

Presentations by Citizens:

1. Council did not receive the presentation by Kayren L. McCarty, Assistant Principal of Early College High School regarding the Early College High School program, due to Ms. McCarty not be able to attend the meeting.

Public Hearings:

1. Council conducted a public hearing to discuss and consider approving an ordinance granting a Conditional Use Permit (CUP) to adjust design requirements for an existing storage business on property designated as B-5 (General Business District), on 5.394 acres described as part of Lot 3, Block 1, and all of Lot 4, Block 1, J.P.T.C. Addition, generally located at 1174 S. Amy Lane, Harker Heights, Bell County, Texas. Joseph Molis, Planning and Development Director, made the presentation. Fountain made the motion to approve based upon staff’s recommendations and findings.  Seconded by Reider. All in favor. Motion approved 4-0.

2. Council conducted a public hearing to discuss and consider approving an ordinance to change zoning designation from B-1 (Office District) To PD-B (Planned Development – Business) on a 6.730 acre tract of land situated in the E.M. Sprott Survey, Abstract No. 772, the R.W. Tom Survey, Abstract No. 840, the J. T. & W. J. Hallmark Survey, Abstract No. 413, and the R. W. Tom Survey, Abstract No. 837, all in Bell County, Texas and being a part or portion of that certain called 46.849 acre tract of land described in Deeds to 2410 Real Estate LP, generally located near the intersection of Hudson Boulevard and Prospector Trail in Harker Heights, Bell County, Texas. Joseph Molis, Planning and Development Director, made the presentation. Michael Beavers was present to represent the request. Reider made the motion to approve with the attached conditions, (page 4, Exhibit A), and based on staff’s facts and findings.  Seconded by Blomquist. All in favor. Motion approved 4-0.

New Business:

1. Council discussed and considered approving a resolution authorizing the City Manager to acquire certain easements for the Line “A” Wastewater Interceptor Project to serve the new Killeen Independent School District Middle School. Mark Hyde, Public Works Director, made the presentation. Blomquist made the motion to approve. Seconded by Nicholas. All in favor. Motion approved 4-0.

2. Council discussed and considered approving an ordinance authorizing the City Manager to enter into a Development Agreement between the City of Harker Heights and Riley Scott Homes, L.L.C., dba Riley Scott Construction for the oversizing of a 12-inch diameter water line within Lot 2B, Block 1, in the amending plat of Lot 2R, Block 1, 2410 Live Oak Addition. Mark Hyde, Public Works Director, made the presentation. Nicholas made the motion to approve an ordinance authorizing the City Manager to enter into a development agreement between the City of Harker Heights and Riley Scott Homes, L.L.C., dba Riley Scott Construction for the oversizing of a 12-inch diameter water line at a not to exceed City cost of $8,180.00. Seconded by Fountain. All in favor. Motion approved 4-0.

3. Council discussed and considered approving an ordinance authorizing publication of Notice of Intention to issue City of Harker Heights, Texas Certificates of Obligation, Series 2019. Alberta Barrett, Finance Director, made the presentation. Reider made the motion to approve.  Seconded by Blomquist. All in favor. Motion approved 4-0.

Reports of Advisory Boards & Commissions:

Councilmember Blomquist stated that he attended the Bell County Public Health District quarterly meeting in Temple. The minutes of the previous meeting were discussed and the Annual Audit was reported on by Lott Vernon and from the findings based on the Federal and the State level, there were no significant issues and they are in compliance with all factors that were looked at. There were two presentations given. The first presentation was by Mrs. Nina Cobb, Bell County Public Health District Outreach Educator, who works across Bell County to tie citizens with charitable organizations and services that meet a wide variety of needs that are available across Bell County. Mr. Blomquist stated that he has Mrs. Cobb’s contact information and will provide it so that it can be available to those that need it. The second presentation was by Kent Stephens, Environmental Health OSSF Section Director, regarding fee changes that will take effect January 1, 2019.  
The fee changes are as follows: 
• Septic Maintenance Inspections – increasing from $10.00 to $15.00
• Real Estate Inspections – increasing from $75.00 to $100.00
• Lot Subdivision Evaluations – increasing from $75.00 to $100.00
• Mobile Home / RV Parks Inspections – increasing from $75.00 to $100.00.

The Board elected Tom Robinson, City of Troy representative, as Vice-chairman of the Board. Dr. Amanda Robison-Chadwell, Director, encouraged everyone to get their flu shot and spoke on the following:
• A concern they have, though not currently a problem in Bell County, is that the Measles has popped up in some larger metropolitan areas, so they are keeping an eye on it.
• Of concern is the Ebola outbreak in Africa and that it has actually reached a major metropolitan area and they are going to start doing screenings across Bell County at all the hospitals for anyone that has been overseas.

Items from Council:

Councilmember Blomquist stated that he attended the Harker Heights Chamber of Commerce Frosted Mug Run on Saturday. 
 
Staff Reports:
 
1. Council received and discussed the unaudited Financial Statements for the Fourth Quarter of FY 2017-2018. Alberta Barrett, Finance Director, made the presentation. No action taken.

2. Council received and discussed the City Manager’s Report. David Mitchell, City Manager, made the presentation. No action taken.

1. Council discussed and considered approving the minutes of the meetings held on October 23, 2018, and October 30, 2018. Reider made the motion to approve as presented. Seconded by Fountain. All in favor. Motion approved by 5-0.

Public Hearings:

1. Council conducted a public hearing to discuss and consider approving an ordinance granting a Conditional Use Permit (CUP) to adjust design requirements for an existing storage business on property designated as B-5 (General Business District), on 5.394 acres described as part of Lot 3, Block 1 and all of Lot 4, Block 1, J. P. T. C. Addition, Property ID# 234634, generally located at 1174 S. Amy Lane, Harker Heights, Bell County, Texas. Joseph Molis, Planning and Development Director, made the presentation. Shanna Komperda and Sean Ferguson were present to represent the request. Fountain made the motion to approve based on Staff’s recommendations and findings. Seconded by Reider. Fountain, Reider, Blomquist, and Nicholas in favor. Schiffman against. Motion passed 4-1.

2. Council conducted a public hearing to discuss and consider approving an ordinance to modify the Planned Development – Mixed Use (PD-M) Conditions from a base residential zoning of R-2 (Two Family Dwelling District) and R-3 (Multi-Family Dwelling District) to PD-M to allow R-1 (One-Family Dwelling District) on 20.069 acres out of the J.M. Cross Survey, Abstract No. 179, being Property ID#s 127920, 198358, 38947, and 127921, generally located at 12590 E. Knights Way (E. FM 2410), Harker Heights, Bell County, Texas. Joseph Molis, Planning and Development Director, made the presentation. Robert Whitson was present to represent the request.  Blomquist made the motion to approve. Seconded by Reider. All in favor. Motion passed 5-0.

3. Council conducted a public hearing to discuss and consider approving an ordinance granting a Conditional Use Permit (CUP) to allow an accessory dwelling unit to be occupied by a relative, on property described as Leasure Addition, Block One (1), Lot One (1), acres 1.432, Property ID# 408903, generally located at 1801 Ponca Trace, Harker Heights, Bell County, Texas. Joseph Molis, Planning and Development Director, made the presentation. Ace Reneau of Mitchell & Associates, Inc., was present to represent the request. Schiffman made the motion to approve based on Staff’s recommendation and findings.  Seconded by Nicholas. All in favor. Motion passed 5-0.

4. Council conducted a public hearing to discuss and consider approving an ordinance granting a Conditional Use Permit (CUP) to allow a masonry clad manufactured home on property described as Five Feathers Addition, Block One (1), Lot Two (2), Property ID# 185944, generally located at 2004 Warriors Path, Harker Heights, Bell County, Texas. Joseph Molis, Planning and Development Director, made the presentation. Larry Pilkey was present to represent the request. Blomquist made the motion to approve with the condition that the owner must within 90 days perfect an election to treat the manufactured home as real property as provided in Texas Occupations Code §1201.2055. Seconded by Fountain. All in favor. Motion passed 5-0.

New Business:

1. Council discussed and considered approving a request by Killeen Independent School District (KISD) for Preliminary Plat approval of Middle School No. 14 on approximately 32.104 acres out of all of that Tract of land out of the H. B. Littlefield Survey, Abstract 511, Bell County, Texas, conveyed Robert Don Sutton, Trustee under the Robert Don Sutton Living Trust dated November 21, 1996 to Killeen Independent School District in a warranty deed recorded in Volume 8961, Page 853, Official Records of Bell County, Texas. Joseph Molis, Planning and Development Director, made the presentation. Jason Scott, Huckabee, Inc. Associate Principal, was present to represent the request. Nicholas made the motion to approve. Seconded by Fountain. All in favor. Motion passed 5-0.

2. Council discussed and considered approving a request for an exemption from the Park Curfew to the Air Force Tactical Air Control Party Association for a 24 Hour Memorial Run and 5K at Carl Levin Park on March 29-30, 2019. Jeff Achee, Parks and Recreation Director, made the presentation. Lt. Col. Frank A. Biancardi, II, Commander and Mr. Robert Kitchenmaster were present to represent the request. Schiffman made the motion to approve. Seconded by Reider. All in favor. Motion passed 5-0.

3. Council discussed and considered approving a resolution awarding the Bank Depository Services Contract to BancorpSouth and authorize the City Manager to sign the contract on behalf of the City. Alberta Barrett, Finance Director, made the presentation. E. K. Hufstedler, III, Valley View Consulting, L.L.C., Randy Sutton and Cassandra Wiggins, BancorpSouth personnel, were present to represent the request. Reider made the motion to approve. Seconded by Schiffman. All in favor. Motion passed 5-0.

4. Council discussed and considered approving a resolution to reject all bids for the Drainage Flume Replacement Project from Mountain Lion Road to Pontiac Drive. Mark Hyde, Public Works Director, made the presentation. Fountain made the motion to approve. Seconded by Reider. All in favor. Motion passed 5-0.

5. Council discussed and considered approving a  resolution authorizing the City’s participation in the Grant Program administered by the Firehouse Subs Public Safety Foundation Grants, LRAD Corporation, for funding the purchase of 31 Individual First Aid Kits (IFAKS), 5 Mass Casualty Kits (25 Individual Kits) and 25 Vehicle IFAKS. Lieutenant Owen Bullard made the presentation. Reider made the motion to approve. Seconded by Schiffman. All in favor. Motion passed 5-0.

6. Council discussed and considered approving a resolution of the City Council of the City of Harker Heights, Texas, adopting the City of Harker Heights 2018-2019 Legislative Platform for the 86th Legislative Session. Jerry Bark, Director of Public Relations, made the presentation. Blomquist made the motion to approve. Seconded by Nicholas. All in favor. Motion passed 5-0.

7. Council discussed and considered approving a resolution of the City of Harker Heights City Council requesting the Members of the 86th Legislative Session of the State of Texas to support Legislation that provides Stewardship, Health and Well Being, and Connectivity for Local and State Parks. Jerry Bark, Director of Public Relations, made the presentation. Reider made the motion to approve. Seconded by Blomquist. All in favor. Motion passed 5-0.

Items from Council:

Mayor Pro-tem Fountain stated that at the TML Conference they had an opportunity to see what Cities were doing throughout the year and that she thinks that the Air Force Tactical Air Control Party Association (TACP) 100 Mile will be a great opportunity to highlight our City.

Councilmember Schiffman left the meeting at 6:33 p.m.

Judge Hall and Alternate Judge Potvin praised the work that the City’s Municipal Court is doing and praised City Court Staff members for their hard work.

3. The Mayor proclaimed November 2nd, 2018, as Texas Arbor Day. Heather Buller, Parks and Recreation Department Activities Coordinator was present to accept the proclamation. Mrs. Buller invited Council, City Staff and citizens to attend the Tree Planting Ceremony on Saturday, November 3, 2018 from 10:30 a.m. -12:00 p.m. at the Summit Soccer Complex to help plant trees.

4. The Mayor recognized Terry and Jackeline Fountain for receiving the 2018 Congressional Veteran Commendation from U. S. Representative John R. Carter.

1. Council received a presentation by the Clements Boys and Girls Club. Clements Board Member Milton Mize introduced Aaron Mandzak, Unit Director to the Council.  Mr. Mandzak introduced the following Harker Heights High School Keystone Club members to the Council:

1. Council conducted a public hearing to discuss and consider approving an ordinance to modify Chapter 74, Transportation Code, Schedule II (A), School Zones, to include locations on Ann Blvd. to reflect a 20 Mph School Zone. Mark Hyde, Public Works Director, made the presentation.  Fountain made the motion to approve. Seconded by Reider. All in favor. Motion approved 5-0.

1. Council discussed and considered approving a resolution authorizing the City Manager to sign the Ambulance Medical Billing-Medical Accounts Receivable Systems (AMB-MARS) Addendum Service Agreement that includes ESO Solutions Fire Billing, Fire Incidents Properties & Inspections, IFC Codesets 2015 And ESO Fire Webinar Training. Paul Sims, Fire Chief, made the presentation. Reider made the motion to approve. Seconded by Schiffman. All in favor. Motion approved 5-0.

Public Hearings Continued:

2. Council conducted a public hearing to discuss and consider approving an ordinance of the City of Harker Heights, Texas, amending the Fire Department Fees Section of The Fiscal Year 2018-2019 Fee Schedule to include Fees for Motor Vehicle Accidents. Paul Sims, Fire Chief, made the presentation. Schiffman made the motion to approve an ordinance to amend the Fiscal Year 2018/2019 fee schedule to include the updated Public Safety / Fire Department Fee Schedule section rates and charges of the City of Harker Heights, Texas; penalties for non-payment; and providing an effective date.  Seconded by Reider. All in favor. Motion approved 5-0.

Spencer H. Smith, Mayor, commended Police Chief Gadd on the retirement ceremony for Commander Loretta Fox, stating that is was a very wonderful experience to see someone that dedicated their professional life to the City for 37 years.  Mayor Smith also commended the Police Department for all that they do and stated that they are proud of the department.

2. Council conducted a public hearing to discuss and consider approving an ordinance to change zoning designation from R-1 (One-Family Dwelling District) to R-1(M) (One-Family Manufactured Home Dwelling District) on property described as Five Feathers Addition, Block One (1), Lot Two (2), identified as property ID# 185944, generally located at 2004 Warriors Path, Harker Heights, Bell County, Texas. Joseph Molis, Planning and Development Director, made the presentation. Fountain made the motion to table the item until Council could speak with the applicant.  The motion died due to a lack of a second.
Schiffman made the motion to disapprove the request.  Seconded by Reider. All in favor. Motion approved 5-0.

3. Council conducted a Public Hearing to discuss and consider an ordinance adopting and approving a Budget for the City of Harker Heights, Texas, for the Fiscal Year beginning October 1, 2018, to September 30, 2019. Alberta Barrett, Finance Director, made the presentation. Reider made the motion to approve. Seconded by Schiffman. Mayor Smith conducted a record vote. The results are as follows: Schiffman voted aye, Blomquist voted aye, Fountain voted aye, Reider voted aye, and Nicholas voted aye. All in favor. Motion approved 5-0.

4. Council conducted a Public Hearing to discuss and consider ratifying the property tax increase reflected in the Fiscal Year 2018 – 2019 Budget. Alberta Barrett, Finance Director, made the presentation. Schiffman made the motion to ratify the property tax increase reflected in the Fiscal Year 2018-2019 Budget and this budget will raise more total property taxes than last year’s budget by $314,412 or 2.6%, and of that amount $251,521 is tax revenue to be raised from new property added to the tax roll this year. Seconded by Fountain. Mayor Smith conducted a record vote. The results are as follows: Schiffman voted aye, Blomquist voted aye, Fountain voted aye, Reider voted aye, and Nicholas voted aye. All in favor. Motion approved 5-0.

5. Council conducted a Public Hearing to discuss and consider an ordinance levying a tax rate for the City of Harker Heights, Texas, for the Tax Year 2018. Alberta Barrett, Finance Director, made the presentation. Reider moved to approve that the property tax rate be increased by the adoption of a tax rate of $0.6770 which is effectively a 0.53 percent increase in the tax rate. Seconded by Blomquist. All in favor. Motion approved 5-0.

6. Council conducted a Public Hearing to discuss and consider an ordinance prescribing and setting the Fiscal Year 2018 – 2019 rates and charges of the City of Harker Heights, Texas; penalties for non-payment; and providing an effective date. Alberta Barrett, Finance Director, made the presentation. Nicholas made the motion to approve. Seconded by Blomquist. All in favor. Motion approved 5-0.

3. Council discussed and considered approving a resolution authorizing the City Manager to sell 0.307 Acres of land, more or less, located at 1502 Eagle Ridge, Harker Heights, Bell County, Texas. Mark Hyde, Public Works Director, made the presentation. Fountain made the motion to approve. Seconded by Nicholas. All in favor. Motion approved 5-0.

4. Council discussed and considered a resolution of the City Council of the City of Harker Heights, Texas approving a negotiated settlement between the ATMOS Cities Steering Committee (“ACSC”) and ATMOS Energy Corp., Mid-Tex Division regarding the Company’s 2018 Rate Review Mechanism Filings; declaring existing rates to be unreasonable; adopting tariffs that reflect rate adjustments consistent with the negotiated settlement; finding the rates to be set by the attached settlement tariffs to be just and reasonable and in the public interest; approving an attached exhibit establishing a benchmark for pensions and retiree medical benefits; approving an attached exhibit regarding amortization of regulatory liability; requiring the Company to reimburse ACSC’s reasonable ratemaking expenses; determining that this resolution was passed in accordance with the requirements of the Texas Open Meetings Act; adopting a savings clause; declaring an effective date; and requiring delivery of this resolution to the Company and the ACSC’s Legal Counsel. Closed Meeting:

1. At 6:01 p.m. the Mayor announced a closed meeting for the following purposes:

2. At 6:11 p.m. the Mayor reconvened the open meeting to take the appropriate action on matters discussed in the closed meeting.

Reider made the motion to re-appoint Garland Potvin as Alternate Judge for a period of two years beginning October 1, 2018 to September 30, 2020.  Seconded by Blomquist.  All in favor.  Motion approved 5-0.

Council member Nicholas stated she attended her last meeting of the Bell County Public Health District yesterday.  For the first time, they have a new member, The City of Rogers, and there are now nine (9) cities that are on the Board.  The Board will be electing a new Vice-Chairman at their next meeting on December 10th, which Council member Blomquist will be attending as her replacement on the Board. The Board discussed communication between the Bell County Public Health District and the member Cities.  They discussed that they update information on Facebook, Twitter and Instagram and that the member Cities should check those sites and that the City can be a part of it and make it available on their City websites since they are starting to communicate more through those sites.

Mayor Pro-tem Fountain thanked Fire Chief Sims and Police Chief Gadd and their Staff for attending the 17th Annual Freedom Walk at the Killeen Independent School District.  Fountain stated that it was good to have full support of the community.

2. Council discussed and considered a resolution adopting the investment policy of the City of Harker Heights, Texas; authorizing the City’s investment broker/dealer list; and approving a list of investment training sponsors. 3. Council discussed and considered appointing a representative to the Bell County Health District Board. David Mitchell, City Manager, made the presentation. Reider made the motion to appoint Councilmember Blomquist to the Bell County Health District Board.  Seconded by Schiffman. All in favor. Motion approved 4-0.

Items from Council:

Councilmember Nicholas gave an update Council on the Bell County Health District.
Nicholas stated that the State of Texas completed a survey on the different counties and it is called the Texas Healthy Communities Program.  The following are some of the survey results for Bell County:
• Bell County received 56 out of 100 points and received an honorable mention.
• Bell County did well in in the following:
    o Bell County has mother friendly works sites, birthing facilities, and hospitals in place in the community.
    o Bell County got 100% / 12 out of 12 points due to having Health Care sites in the community that promote primary and secondary prevention of CV and stroke.
• Three (3) out of eight (8) areas Bell County did not get as high in are the following:
    o Physical activity areas and opportunities for safe accessible areas in the community, Bell County got 3 points out of 14.
    o Healthy food options to be accessible and promoted to all members of the community, Bell County got 1 point out of 11.
    o Advanced Life Support vehicles, Bell County did not do better than 50%.
• The Survey recommended that Bell County campaing for a local advisory board to raise awareness about stroke and heart attacks and that when people are at risk or are in danger that they call 9-1-1, which for some reason is not there anymore.
• Other areas that Bell County did well in were:
    o Public Schools
    o Work sites
    o Wellness programs
    o Comprehensive tobacco control program
• The City has a 100% smoke free City Smoking Ordinance in place and Bell County got 12.5 points out of 14

Blomquist made the motion to approve the Ordinance and to strike the word “such” from Section 4, Subsection C, Sub-paragraph 1.  The motion died due to a lack of a second.
Schiffman made the motion to approve the ordinance to include the word “such” in Section 4, Subsection C, Sub-paragraph 1.  Seconded by Fountain. Reider, Schiffman, Nicholas, and Fountain in favor. Blomquist against. Motion passed 4-1.

2. The Council discussed and considered approving the Ad Valorem Tax Rate for the fiscal year 2018-2019 and scheduled public hearings.  Alberta Barrett, Finance Director, made the presentation.  The public hearings will be held on August 21st, and August 28th, 2018. The proposed tax rate of $0.6770 per $100 valuation will be placed on the September 11th, 2018 Council agenda. Blomquist made a motion to place a proposal to adopt the tax rate of $0.6770 per $100 valuation on the September 11, 2018 council agenda.  Seconded by Reider. Mayor Smith conducted a record vote.  The results are as follows: Nicholas voted aye, Reider voted aye, Fountain voted aye, Blomquist voted aye, & Schiffman voted aye.  All in favor. Motion approved 5-0.

1. Council conducted a public hearing to discuss and consider approving an ordinance to change zoning designation from R-1 (One-Family Dwelling District) to B-4 (Secondary and Highway Business District) on property described as A0258BC E Dawson, 4, Acres 3.007, identified as property ID# 393005, generally located on Cedar Knob Road between Loblolly Drive and E. Knights Way, Harker Heights, Bell County, Texas. Joseph Molis, Planning and Development Director, made the presentation. Justin Fuller with Clark & Fuller, PLLC was present to represent the request.  Reider made the motion to approve with the addition of an 8-foot privacy fence along the eastern property line as allowed under § 150.38 Additional Screening or Fencing, based on staff’s recommendation and findings. Seconded by Schiffman. All in favor. Motion approved 5-0.

2. Council conducted a public hearing to discuss and consider approving an ordinance granting a Conditional Use Permit (CUP) to allow a Small Animal Veterinary Hospital and Indoor Boarding Facility on properties described as 0.551 Acres out of the R. 2. Discuss and consider approving an ordinance amending the Fee Schedule of the City of Harker Heights to waive one-half (1/2) of the Building Permit and Platting Fees attributed to the construction of the New Middle School #14 on Warriors Path by the Killeen Independent School District (KISD); Amending Table VIII of the Table of Special Ordinances to reflect such action; providing an effective date. 1. Council discussed and considered approving a resolution of the City of Harker Heights Employee Benefits Trust awarding contracts for the City of Harker Heights Employee Benefits Trust Group Medical Plan, Vision Benefits, Dental Benefits, Life Insurance, AD&D and Long Term Disability and authorizing the City Manager to enter into such contracts on behalf of the City and the Employee Benefits Trust. Leona Clay, Human Resource Director, introduced the City Consultant, Bob Treacy, Life and Health Insurance Counselor at Gallagher Benefit Services who made the presentation.
Reider made the motion to approve a resolution of the City of Harker Heights Employee Benefits Trust awarding contracts for the City of Harker Heights Employee Benefits Trust group medical plan to United Health Care, Superior Vision for vision benefits, Lincoln Financial for dental benefits, life insurance, AD&D, and long term disability benefits and authorize the City Manager to enter into such contracts on behalf of the City and the Employee Benefits Trust. The event honored out nations’ Veterans from the Korean War and those who continue to serve in Korea.

3. The Council discussed and considered approving a request for Alcohol Services for the Harker Heights Chamber of Commerce “Central Texas Food, Wine & Brew Festival” at 2410 Community Park. Jerry Bark, Parks and Recreation Director, made the presentation. Gina Pence, President and CEO of the Harker Heights Chamber of Commerce, was present to represent the request. Schiffman made the motion to approve a request for Alcohol Services for the Harker Heights Chamber of Commerce “Central Texas Food, Wine & Brew Festival” at 2410 Community Park for September 8, 2018. 4. The Council discussed and considered approving a resolution of the City Council of the City of Harker Heights, Texas awarding a financing in an amount of $495,000 for Communications Equipment and making certain findings related thereto. Alberta Barrett, Finance Director, made the presentation. Blomquist made the motion to approve. Seconded by Nicholas. All in favor. Motion approved 5-0.

At 6:31 p.m. Councilmember John Reider filed an Affidavit for Conflict of Interest for New Business item number five and left the meeting.

5. The Council discussed and considered approving a resolution awarding a contract for the Roundabout at Heights Drive and Commercial Drive Project in the amount of $849,131.45 to TTG Utilities, LP. Councilmember Nicholas stated that she attended the Quarterly meeting for the Bell County Public Health District for Harker Heights.  They discussed the following events and issues; the Environmental Health Division moved into a new building at 2905 West Adams Ave, Temple, Texas; the City’s member contribution will remain at $69,119.00 until the next census; they discussed that there are no indications of the Zika virus at this time in Harker Heights and they are looking for any indication of the West Nile Virus; and they discussed that the Harker Heights area has the highest average of cases of Salmonella in the State, and that Harker Heights is at 76% of the norm. 

Mayor Pro-tem Fountain stated that she attended a lunch for the first Women’s Veteran’s Day event.  Texas officially has a Women’s Veteran’s Day and it is June 12th.

David Mitchell, City Manager made the presentation.  Schiffman made the motion to recommend approval of replacing the City’s KTMPO Technical Advisory Committee representative from the City Manager to the Planning Director and to assign the City Manager as his alternate. It was an absolutely stunning event where the forty (40) highest GPA graduating seniors from the four (4) KISD High Schools were recognized. 

Mayor Spencer H. Smith stated that he had the opportunity to address the Texas Convention for the Military Order of the Purple Heart on Saturday. The City of Harker Heights is a Purple Heart City and has an outstanding chapter.

1. The Council conducted a Public Hearing to discuss and consider approving an ordinance granting a rezoning request from R-1 (One Family Dwelling District) To R-2 (Two Family Dwelling District) on property described as Wildewood Acres, Block 001, Lot 0009, & 20' Strip Adjacent on North, identified as Property Id# 32902, generally located at 917 Ramblewood Drive, and property described as Wildewood Acres, Block 001, Lot 0008, & 20' Strip Adjacent on North, identified as Property Id # 32901, generally located at 915 Ramblewood Drive, Harker Heights, Bell County, Texas. Joseph Molis, Planning and Development Director, made the presentation. Glenn Morrison, of Flintrock Builders, was present to represent the request. Carpenter made the motion to approve based on Staff recommendations. Seconded by Reider. All in favor. Motion approved 5-0.

At 5:14 p.m. Councilmember Jackeline Soriano Fountain filed an Affidavit for Conflict of Interest for Public Hearing item number two and left the meeting.

2. The Council conducted a Public Hearing to discuss and consider approving an ordinance granting a Conditional Use Permit (CUP) request to allow an accessory dwelling unit on property described as Whitten Place, Block 001, and Lot 0009, Property Id #90800, generally located at 1107 Old Oak Road, Harker Heights, Bell County, Texas.  Joseph Molis, Planning and Development Director, made the presentation. Terry Fountain, property owner, was present to represent the request. Reider made the motion to approve based on Staff recommendations. Seconded by Schiffman. All in favor. Motion approved 4-0.

At 5:24 p.m. Councilmember Jackeline Soriano Fountain returned to the meeting.

3. The Council conducted a public hearing to discuss and consider approving an ordinance to abandon (vacate) five feet of a fifteen foot wide utility easement located across Lot 16, Block 1,  Evergreen, Phase 1 (2531 Boxwood Drive). Mark Hyde, Public Works Director, made the presentation. Fountain made the motion to approve an ordinance to abandon (vacate) five feet of a fifteen foot wide utility easement located across Lot 16, Block 1,  Evergreen, Phase 1 (2531 Boxwood Drive) and further described in “Exhibit A”. Seconded by Reider. All in favor. Motion approved 5-0.

New Business:

1. The Council discussed and considered approving a resolution awarding a contract for the Drainage Capital Improvement Program #2, Phase 1 Project in the amount of $269,412.95 to TTG Utilities, LP. Mark Hyde, Public Works Director, made the presentation. Nicholas made the motion to approve a resolution awarding a contract for the Drainage CIP #2, Phase 1 Project Bid in the amount of $269,412.95 to TTG Utilities, LP. Seconded by Reider. All in favor. Motion approved 5-0.

2. The Council discussed and considered approving a resolution authorizing the City Manager to sign the Harker Heights Public Library Annual Report for Fiscal Year 2016 – 2017 and Accreditation in State Library System Application Local Fiscal Year 2017.

Schiffman made the motion to approve Consent Items #1 & #2.  Seconded by Fountain.  All in Favor.  Motion approved 5-0.

New Business:

1. The Council discussed and considered approving an ordinance authorizing the City Manager to enter into a Development Agreement between the City of Harker Heights and WBW Land Investments, LP for the oversizing of a center left turn lane on FM 3481 for the benefit of north bound traffic turning on Halona Drive. Joe Hines, Utility Superintendent, made the presentation. Schiffman made the motion to approve a resolution declaring engineering firms listed on Schedule A, to be pre-qualified for the 2018 RFQ for General Civil Engineering Services for water, wastewater, transportation and drainage projects. Seconded by Nicholas. All in favor. Motion approved 5-0.

3. The Council discussed and considered approving a resolution of the City of Harker Heights, Texas, finding that Oncor Electric Delivery Company LLC’s application for approval of a Distribution Cost Recovery Factor pursuant to 16 Texas Administrative Code § 25.243 to increase distribution rates within the City should be denied; finding that the City’s reasonable rate case expenses shall be reimbursed by the Company; finding that the meeting at which this resolution is passed is open to the public as required by law; requiring notice of this resolution to the company and legal counsel.  Alberta Barrett, Finance Director, made the presentation. Schiffman made the motion to approve.  Seconded by Nicholas. All in favor. Motion approved 5-0.

1. The Council discussed and considered approving an ordinance of the City Council of the City of Harker Heights, Texas, approving a tariff authorizing an Annual Rate Review Mechanism (“RRM”) as a substitution for the Annual Interim Rate Adjustment Process defined in Section 104.301 of the Texas Utilities Code and as negotiated between ATMOS Energy Corp., Mid-Tex Division (“ATMOS Mid-Tex” or “Company”) and the Steering Committee of Cities served by ATMOS; requiring the Company to reimburse Cities’ reasonable ratemaking expenses; adopting a savings clause; determining that this ordinance was passed in accordance with the requirements of the Open Meetings Act; declaring an effective date; and requiring delivery of this ordinance to the Company and Legal Counsel for the Steering Committee. Items from Council:

Councilmember Nicholas stated that she represented the City yesterday at the Bell County Public Health District.  The Director mentioned that they are doing a study on tobacco usage.  Bell County has one of the highest numbers in the area and they are doing it from eighteen (18) year olds and higher. The Director said there is a survey online on the Bell County Public Health Districts website.  Cathy Brown told them that there is a downward slope for the flu and that this week there was only 263 cases.  Bell County Public Health District did get an award from the Texas Department of Public Safety for their preparedness and they reflected on a couple of different instances where they worked above and beyond when the City had the hurricane victims up here and the City’ preparedness. The City had actually assisted other areas that needed their help and did not know they needed their help.  They were recognized which was a really big deal because they have never really been awarded from that high of a level before.  Ken Steve from the Environmental Health mentioned that they are needing to relocate their offices from Temple.

2. The Council discussed and considered approving a resolution authorizing the City’s participation in the grant program administered by the Office of the Governor Homeland Security Grant Division for funding the purchase of one Emergency Power Generator System. Carpenter made the motion to approve the resolution authorizing the City’s application for a grant through the Homeland Security Grant Division in the amount of $155,000.00 for the purchase of an emergency generator power system for the recreation center. Consent Items:

1. The Council discussed and considered approving the minutes of the meeting held on January 23, 2018.  Nicholas made the motion to approve.  Seconded by Carpenter.  All in favor. Motion approved 4-0.

Public Hearings:

1. The Council conducted a Public Hearing to discuss and consider approving an ordinance granting a rezoning request from R-3 (Multi-Family Dwelling District) to R1-I (One Family Infill Dwelling District) on property described as Valley View Third Ext, Block 011, Lot 0032 Property ID# 51951, generally located at 223 East Valley Road, Harker Heights, Bell County, Texas. Joseph Molis, Planning and Development Director, made the presentation. Juan Lopez applicant was present to represent the request. Reider made the motion to approve with staff recommendations and findings. Seconded by Fountain. All in favor. Motion approved 4-0.

2. The Council conducted a Public Hearing to discuss and consider approving an ordinance granting a Conditional Use Permit (CUP) to allow an accessory dwelling unit on property described as Salinas Addition, Block 001, Lot 0001, acres 2.0, Property ID# 238864, generally located at 3806 Oakridge Boulevard, Harker Heights, Bell County, Texas. Joseph Molis, Planning and Development Director, made the presentation. Carpenter made the motion to approve. Seconded by Reider. All in favor. Motion approved 4-0.

3. The Council conducted a Public Hearing to discuss and consider approving an ordinance amending Section 150.02 of the Code of Harker Heights, to adopt the 2017 National Electric Code. Steve Philen, Building Official, made the presentation. Reider made the motion to approve as presented. Seconded by Nicholas. All in favor. Motion approved   4-0.


New Business:

1) The Council discussed and considered a resolution authorizing BBVA Compass Bank to be added to the City’s Investment Broker/Dealer list. Ayesha Lealiiee, Assistant Finance Director, made the presentation.  Fountain made the motion to approve.  Seconded by Nicholas. All in favor. Motion approved 4-0.

2) The Council discussed and considered approving a resolution authorizing the City’s Application for a Grant through the Office of the Governor funding the purchase of a Digital Crime Scene Reconstruction Diagraming Station. Phillip Gadd, Assistant Police Chief, made the presentation. Carpenter made the motion to approve the resolution authorizing the City’s application for a grant in the amount of $27,503.28 through the Office of the Governor for the purchase of a Digital Crime Scene Reconstruction Diagraming Station.  Seconded by Reider. All in favor. Motion approved 4-0.

3) The Council discussed and considered approving a resolution authorizing the City’s Application for a Grant through the Office of the Governor funding the purchase of 12 Conducted Energy Devices (Tasers) for the Police Department. Phillip Gadd, Assistant Police Chief, made the presentation. Reider made the motion to approve the resolution authorizing the City’s application for a grant in the amount of $14,640.00 through the Office of the Governor for the purchase of twelve (12) Conducted Energy Devices (Tasers). Seconded by Fountain. All in favor. Motion approved 4-0.

4) The Council discussed and considered approving a resolution authorizing the City’s application for a Grant through the Department of Homeland Security’s Federal Emergency Management Agency (FEMA) National Preparedness Directorate funding the purchase of 12 Handheld and 9 Vehicle Mount P25 Compliant Radios. Phillip Gadd, Assistant Police Chief, made the presentation. Nicholas made the motion to approve the resolution authorizing the City’s application for a grant in the amount of $49,112.00 through the Department of Homeland Security for the purchase of twelve (12) Handheld and nine (9) Vehicle Mount P25 Compliant Radios.  Seconded by Reider. All in favor. Motion approved 4-0.

5) The Council discussed and considered approving a resolution authorizing the City’s application for a Grant through the Department Of Homeland Security funding the purchase of Two Tactical Micro-Robots. Phillip Gadd, Assistant Police Chief, made the presentation. Nicholas made the motion to approve the resolution authorizing the City’s application for a grant in the amount of $24,590.00 through the Department of Homeland Security for the purchase of two (2) Tactical Micro-Robots. Seconded by Reider. All in favor. Motion approved 4-0.

Reports of Advisory Boards & Commissions:

1. The Council received and discussed a presentation regarding the 2017 Annual Summary Reports of the Planning and Zoning Commission and Building and Standards Commission. Larry Robison, Planning and Zoning Commission Chairman, made the presentation. No action taken.


Staff Reports:
 
1. The Council received and discussed the FY 2017-2018 First Quarter Investment Report. Ayesha Lealiiee, Assistant Finance Director, made the presentation. No action taken.

2. The Council received and discussed the Unaudited Financial Statements for the First Quarter of FY 2017-2018. Ayesha Lealiiee, Assistant Finance Director, made the presentation. No action taken.

3. The Council received and discussed the City Manager’s Report. David Mitchell, City Manager, made the presentation.  No action taken.

Closed Meeting:

At 6:16 p.m. the Mayor announced a closed meeting for the following purposes:

A) Pursuant to §551.074 of the Texas Government Code to discuss and deliberate the appointment of a public officer to the Planning and Zoning Commission and Building and Standards Commission.

At 6:30 p.m. the Mayor reconvened the open meeting to take the appropriate action on matters discussed in the closed meeting.

Reider made the motion to appoint Alternate member Colen Wilson as a Regular Member to the Planning and Zoning Board and Building and Standards Commission. Mr. Wilson will serve the unexpired term for Jeff Orlando effective February 28, 2018 to January 2020. Seconded by Carpenter. All in favor. Motion passed 4-0.

Schiffman made the motion to approve Consent Items #1 & #2.  Seconded by Nicholas.  All in Favor.  Motion approved 3-0.

New Business:

1. Discuss and consider adopting an ordinance authorizing the issuance and sale of City Of Harker Heights, Texas, Combination Tax and Revenue Certificates of Obligation, Series 2018, in a maximum aggregate principal amount of $6,000,000; levying a tax in payment thereof; authorizing the sale of said certificates of obligation; authorizing the execution and delivery of a paying agent/registrar agreement; approving the official statement; finding and determining that the meeting at which this ordinance is passed is open to the public as required by law; and enacting other provisions relating thereto. Alberta Barrett, Finance Director, made the presentation. The City’s Financial Advisor, Garry Kimball of Specialized Public Finance was present to review the rates and process for funding. Schiffman made the motion to approve.  Seconded by Fountain. All in favor. Motion approved 3-0.

2. Receive and discuss a presentation regarding amending or updating the Harker Heights Code of Ordinances Section 51.16 – Dumpster Requirements. Joseph Molis, Planning and Development Director, made the presentation. This item will be brought back to Council for consideration at a future meeting. No action taken.

1. The Council received and discussed the City Manager’s Report. David Mitchell, City Manager, made the presentation. No action taken.

Announcements:

Mayor Smith recognized that Gina Pence, President and CEO of the Harker Heights Chamber of Commerce, was at the meeting and thanked her for attending. Mayor Smith stated that the Military Affairs Committee event today was well attended and was a really good event for them and gave kudos to the chamber.

1. The Council received and discussed a presentation regarding the Child Safety Fund. Shay Luedeke, Bell County Tax Assessor, was in attendance and presented the City with a check for $32,612.05.00 from the Bell County Child Safety Fund. No action taken.

Public Hearing:

1. The Council conducted a Public Hearing to discuss and consider approving a rezoning request from R-1 (One-Family Dwelling District) to R2-I (Two-Family Infill Dwelling District), on property described as Kern Acres 1st Extension & Revision, Block 005, Lot 0014, Property ID# 10560, generally located at 304 Harley Drive, Harker Heights, Bell County, Texas. Joseph Molis, Planning and Development Director, made the presentation. Michael Schulte applicant was present to represent the request. Schiffman made the motion to approve with staff recommendation. Seconded by Fountain. All in favor. Motion approved 5-0.

2. The Council conducted a Public Hearing to discuss and consider approving a rezoning request from R-1 (One-Family Dwelling District) to R-2 (Two-Family Dwelling District), on property described as Wildewood Acres Re-plat (Lots 3-4, Block 5), Block 005, Lot 003A, Property ID# 3256, generally located at 905 Rosewood Drive, Harker Heights, Bell County, Texas. Joseph Molis, Planning and Development Director, made the presentation. Raymond Hamden applicant was present to represent the request. Fountain made the motion to approve with staff’s recommendations. Seconded by Nicholas. All in favor. Motion approved 5-0.

3. The Council conducted a Public Hearing to discuss and consider approving a Conditional Use Permit (CUP) for the purpose of allowing a Garden Home Community on property described as Briarwood Estates Phase IV, Block 001, Pt of 2.740 AC Tract, Acres 2.683, Property ID# 334238, generally located at the east of Preswick Circle, Harker Heights, Bell County, Texas. Joseph Molis, Planning and Development Director, made the presentation. Jeff Lackmeyer applicant was present to represent the request. Reider made the motion to approve. Seconded by Fountain. All in favor. Motion approved5-0.

4. The Council conducted a Public Hearing to discuss and consider approving an ordinance amending Chapter 90 of the Code of Ordinances amending city regulation of dangerous dogs. Gary Bates, IT Director, made the presentation. Schiffman made the motion to approve an ordinance amending city regulation of dangerous dogs. Seconded by Reider. All in favor. Motion approved 5-0.

5. The Council conducted a Public Hearing to discuss and consider approving an ordinance amending Chapter 90 of the Code of Ordinances to require mandatory sterilization of animals under certain circumstances. Gary Bates, IT Director, made the presentation. Fountain moved to approve an ordinance amending Chapter 90 of the Code of Harker Heights to require mandatory sterilization of animals under certain circumstances. Seconded by Nicholas. All in favor. Motion approved 5-0.

New Business:

1. The Council discussed and considered a request by John Robert Whitson for preliminary plat approval for Pecan Meadows Subdivision described as A0179BC J M Cross, 3-3-1, Acres 1.504, with Property ID# 127920, A0179BC J M Cross, Acres 2.097, With Property ID# 198358, A0179BC J M Cross, 3-3, Acres 9.469, with Property ID# 38947, A0179BC J M Cross, 3-3-2, Acres 6.949 with Property ID# 127921, generally located at 12590 E. Knights Way (E. FM 2410), Harker Heights, Bell County, Texas. Joseph Molis, Planning and Development Director, made the presentation. At 5:54 p.m. Councilmember John Reider filed an Affidavit for Conflict of Interest for New Business item number two and left the meeting.

2. The Council discussed and considered a request by Ampler Development, LLC. for preliminary/final plat approval for Charvick Addition Re-plat Described As Charvick Addition Lots 1R and 2, Block 2, being a Re-plat of Charvick Addition Lot 1, Block 1, recorded in Volume 2013, Page 49, P.R.C.T., W.F. Hunt Survey, Abstract No. 458, Property ID# 453651, generally located at 680 E. Knights Way (E. FM 2410), Harker Heights, Bell County, Texas.  Joseph Molis, Planning and Development Director, made the presentation. Schiffman made the motion to approve a preliminary plat for approximately 1.543 of land described as Charvick Addition Lots 1R and 2 Block 1 being a re-plat of Charvick Addition Lot 1, Block 1 recorded in Volume 2013, Page 49, P.R.C.T, W. 3. The Council discussed and considered approving a resolution authorizing the City Manager to negotiate and sign a “Professional Services Contract” for engineering services with Thonhoff Consulting Engineers, Inc. for the Line “A” Sanitary Sewer Interceptor Project. Joe Hines, Utility Superintendent made the presentation. Carpenter made the motion to approve. Seconded by Reider.  All in favor. Motion approved 5-0.

Announcements:

Mayor Smith spoke about his trip to Bangkok, Thailand over the Christmas and New Year’s Holiday. He stated that the parks over there are wonderful. In a city of approximately ten million people their drivers were incredible, so when the city gets the round-about going we probably need to bring somebody over to help talk to use. It is amazing how people go through there, nobody is honking and nobody is giving high signs or anything in traffic and probably the most interesting thing is that they all back in to park and parking is at a premium so if all the lots are full you can park your car perpendicular to a guy and lock your car up and leave it in neutral so if they got to get out they just push your car out of the way.
