Minutes of the City Council Meeting held at 5:00 p.m. on Tuesday, December 10, 2019, in the Kitty Young Council Chamber at the Harker Heights City Hall at 305 Miller’s Crossing, Harker Heights, Texas 76548:

Mayoral Proclamations and Presentations: 

1. The Mayor presented a proclamation to Tatiana Toribio declaring her a “Bright Star of Central Texas”.

Consent Items:

1. Council discussed and considered approving the minutes of the meeting held on November 12, 2019. Blomquist made the motion to approve as written. Seconded by Nicholas.  All in favor. Motion approved 5-0.

Presentations by Citizens:

1. Council received a presentation from John Frees, Citizen, regarding a possible zoning overlay to allow “tiny houses” in the City of Harker Heights. No action taken.

New Business:

1. Council discussed and considered approving a resolution authorizing the City’s participation in the 2019 Defense Economic Adjustment Assistance Grant (DEAAG) Project. Jerry Bark, Public Relations Director, made the presentation. Fountain made the motion to approve. Seconded by Reider. All in favor. Motion approved 5-0.

At 5:13 p.m. Mayor Pro-tem Michael Blomquist filed an Affidavit for Conflict of Interest for New Business item number two and left the meeting.

2. Council discussed and considered a resolution granting a waiver of permitting fees in the amount of $35.00 for residential homes with On-Site Sewage Facilities (OSSF’s) and Unapproved Irrigation Backflow Prevention Assemblies, located within the geographical area depicted in Exhibit “A”. Mark Hyde, Public Works Director, made the presentation. Nicholas made the motion to approve. Seconded by McCann. All in favor. Motion approved 4-0.

 At 5:20 p.m. Mayor Pro-tem Michael Blomquist returned to the meeting.

3. Council discussed and considered approving a resolution authorizing the City Manager to terminate a Water Supply Agreement with Dog Ridge Water Supply Corporation. Mark Hyde, Public Works Director, made the presentation. Reider made the motion to approve. Seconded by Blomquist. All in favor. Motion approved 5-0.

4. Council discussed and considered approving a resolution awarding a contract for the Warriors Path Reconstruction, Phase I Project in the amount of $2,248,816.47 to Gary W. Purser Construction, LTD. Mark Hyde, Public Works Director, made the presentation. Nicholas made the motion to approve. Seconded by McCann. All in favor. Motion approved 5-0.

Mayoral Proclamations and Presentations: 

1. The Mayor presented a proclamation to Lisa Youngblood, Library Director, proclaiming November 18th – 23rd, 2019, as “Harker Heights Children’s Book Week”.

2. Ms. McKinzie was not able to attend the meeting thus the Mayor did not present the proclamation to Kylie McKinzie declaring her a “Bright Star of Central Texas”.

1. Council discussed and considered approving the minutes of the meeting held on October 22, 2019. Reider made the motion to approve as written. Seconded by Nicholas. All in favor. Motion approved 3-0.

New Business:

1. Council discussed and considered a request by Open Air Resort Harker Heights Real Estate Holdings, LLC for preliminary plat approval for the proposed Open Air Addition, on property described as 31.366 acre tract of land situated in the Vincent L. Evans Survey, Abstract No. 288, Bell County, Texas and being a part or portion of that certain 51.161 acre tract of land described in a Warranty Deed with Vendor’s Lien dated January 16, 2019 from George C. Moss, individually and as Independent Executor of the Estate of Adelheid K. Moss, Deceased and as Trustee of the Catherina D. Misner Trust to Roy Reynolds Estates, LLC, A Texas Limited Liability Company and being of record in Document No. 2019-00002238, Official Public Records of Bell County, Texas, generally located at 101 N. Roy Reynolds Drive, Harker Heights, Bell County, Texas. Courtney Peres, Senior Planner/GIS Coordinator, made the presentation.  Blomquist made the motion to approve seeing that Condition 1: the survey has been finalized by the City Council Meeting and Condition 2: City Council has determined that the applicant has satisfied Condition 1, which results in full approval by the Planning and Zoning Commission. Seconded by Nicholas. All in favor. Motion approved 3-0.

2. Council discussed and considered a resolution granting a waiver of permitting fees in the amount of $35.00 for residential homes with On-Site Sewage Facilities (OSSF’s) and Unapproved Irrigation Backflow Prevention Assemblies, located within the geographical area depicted in Exhibit “A”.  This item was tabled due to a lack of a quorum.

2. The Mayor presented a proclamation to Municipal Court Judge Billy Ray Hall proclaiming November 4th – 8th, 2019, as Municipal Court Week. Judge Hall praised the work that the City’s Municipal Court is doing and praised City Court Staff members for their hard work.

3. The Mayor presented a proclamation to Jeff Achee, Parks and Recreation Director, proclaiming November 1st, 2019, as Texas Arbor Day.

1. Council discussed and considered approving the minutes of the meetings held on September 24, 2019 and October 15, 2019. Nicholas made the motion to approve. Seconded by Fountain. All in favor. Motion approve 4-0.

New Business:

1. Council discussed and considered a request by Jerome and Rachel Gomer for Preliminary Plat approval for the proposed Sapiah Plains Phase Two, on 3.397 acres being part of the H.B. Littlefield Survey, Abstract No. 511, being part of a called 5.44 acre tract of record in Volume 1380, Page 255, Deed Records of Bell County, Texas, generally located at the corner of Ute Trail and Warriors Path, Harker Heights, Bell County, Texas. Joseph Molis, Planning and Development Director, made the presentation. Ace Reneau, Mitchell & Associates, Inc., was present to represent the request. Blomquist made the motion to approve with the condition of the inclusion of a one foot (1’) vehicular non-access easement along the Warriors Path frontage. Seconded by Fountain. All in favor. Motion approved 4-0.
2. Council discussed and considered a request by Jerome and Rachel Gomer for Concept Plan approval on property described as 1.442 acres of land, more or less, described in a General Warranty Deed Recorded Under Instrument Number 2019-00021233 in the Real Property Records of Bell County, Texas, generally located at 1808 Ponca Trace, Harker Heights, Bell County, Texas. Joseph Molis, Planning and Development Director, made the presentation. Ace Reneau, Mitchell & Associates, Inc., was present to represent the request. Fountain made the motion to approve. Seconded by Nicholas. All in favor. Motion approved 4-0.

3. Council discussed and considered approving a resolution awarding a contract for the Iron Chloride Odor Control System at the Trimmier Creek Lift Station in the amount of $115,932.00 to Primespec Construction, LLC. Mark Hyde, Public Works Director, made the presentation. Blomquist made the motion to approve. Seconded by McCann. All in favor. Motion approved 4-0.

4. Council discussed and considered approving an ordinance amending the City of Harker Heights Code of Ordinance by the addition of Chapter 105: Parks and Recreation, prescribing rules and regulations for the use of Municipal Parks and Recreation Facilities, and providing for enforcement and penalties for violation of such rules and regulations. Jeff Achee, Parks and Recreation Director, made the presentation. McCann made the motion to approve. Seconded by Nicholas. All in favor. Motion approved 4-0.

5. Council discussed and considered approving an ordinance of the City of Harker Heights, Texas, amending the Parks and Recreation Fees on the 2019-2020 City Fee Schedule to include the commercial use fees. Jeff Achee, Parks and Recreation Director, made the presentation. Blomquist made the motion to approve. Seconded by McCann. All in favor. Motion approved 4-0.

6. Council discussed and considered approving an ordinance reorganizing Chapter 90 of the City of Harker Heights, Texas, Code of Ordinance and clarifying ownership rights to an unclaimed animal. Gary Bates, IT Director, made the presentation. Nicholas made the motion to approve. Seconded by Fountain. All in favor. Motion approved 4-0.

7. Council discussed and considered approving a resolution reappointing Jared Bryan as the City of Harker Heights Representative on the Board of Directors of the Tax Appraisal Board of Bell County, Texas. David Mitchell, City Manager, made the presentation. Nicholas made the motion to approve. Seconded by McCann. All in favor. Motion approved 4-0.

Closed Meeting

1. At 5:56 p.m. the Mayor announced a closed meeting for the following purpose:

A) Pursuant to §551.074 of the Texas Government Code to deliberate the appointment of public officers to the Planning and Zoning Commission and Building Standards Commission.

B) Pursuant to §551.074 of the Texas Government Code to deliberate the appointment of public officers to the Zoning Board of Adjustment.

2. At 6:22 p.m. Mayor Spencer H. Smith reconvened the open meeting to take action as appropriate on matters discussed in the closed meeting.

Public Hearings:

1. Council conducted a public hearing to discuss and consider approving an ordinance to amend conditions of the PD-B (Planned Development Business) Zoning District to allow additional parking arrangements on the property located at 107 Mountain Lion Road, described as 2.930 Acres (previously called 2.925 acres) out of the R.W. Tom Survey, Abstract No. 838, being the same tract conveyed to Armed Services YMCA of the USA, Killeen, recorded in Instrument No. 2014-00021525, Real Property Records of Bell County, Texas. Joseph Molis, Planning and Development Director, made the presentation. Steven Watson, representative for the property at 111 Mountain Lion Road, was present to represent the request. Fountain made the motion to approve. Seconded by McCann. All in favor. Motion approved 4-0.

1. Council discussed and considered approving a resolution authorizing the Mayor to sign a Memorandum of Understanding between the City of Harker Heights, Texas, and the City of Killeen, Killeen Independent School District and Bell County that establishes the scope of the Chaparral Road Realignment/Reconstruction Project and responsibilities of each of the parties as it relates to the project. 2. Council discussed and considered approving an ordinance of the City Council of the City of Harker Heights, Texas, approving a negotiated settlement between the ATMOS Cities Steering Committee (“ACSC”) and ATMOS Energy Corp., Mid-Tex Division regarding the Company’s 2019 Rate Review Mechanism Filings; declaring existing rates to be unreasonable; adopting tariffs that reflect rate adjustments consistent with the negotiated settlement; finding the rates to be set by the attached settlement tariffs to be just and reasonable and in the public interest; approving an attached exhibit establishing a benchmark for pensions and retiree medical benefits; approving an attached exhibit regarding amortization of regulatory liability; requiring the Company to reimburse ACSC’s reasonable ratemaking expenses; determining that this ordinance was passed in accordance with the requirements of the Texas Open Meetings Act; adopting a savings clause; declaring an effective date; and requiring delivery of this ordinance to the Company and the ACSC’s Legal Counsel. 6. Council conducted a Public Hearing to discuss and consider ratifying the property tax increase reflected in the Fiscal Year 2019 – 2020 Budget, record the vote. Alberta Barrett, Finance Director, made the presentation.

Mr. Howard Scott Arey, 2027 Sandy Point, Harker Heights, Texas 76548, gave a short presentation regarding the proposed ad valorem tax rate for the City of Harker Heights.

Reider made the motion to ratify the property tax increase reflected in the Fiscal Year 2019-2020 Budget and this budget will raise more total property taxes than last year’s budget by $783,427 or 6.5%, and of that amount $235,458 is tax revenue to be raised from new property added to the tax roll this year. Seconded by Fountain. Mayor Smith conducted a record vote. The results are as follows: McCann voted aye, Fountain voted aye, Blomquist voted aye, Reider voted aye, and Nicholas voted aye. All in favor. Motion approved 5-0.

7. Council conducted a Public Hearing to discuss and consider an ordinance levying a tax rate for the City of Harker Heights, Texas, for the Tax Year 2019. Alberta Barrett, Finance Director, made the presentation. Nicholas moved to approve that the property tax rate be increased by the adoption of a tax rate of $0.6770 which is effectively a 4.6 percent increase in the tax rate. Seconded by Reider All in favor. Motion approved 5-0.

8. Council conducted a Public Hearing to discuss and consider an ordinance prescribing and setting the Fiscal Year 2019 – 2020 rates and charges of the City of Harker Heights, Texas; penalties for non-payment; and providing an effective date. 1. Council conducted a public hearing to discuss and consider approving an ordinance granting a Conditional Use Permit (CUP) to allow uses associated with a B-1 Zoning District or a Real Estate Office on property described as Lot Four (4), Block Ten (10), Highland Oaks Estates Section Three (3), a subdivision in the City of Harker Heights according to the Plat in Cabinet A, Slide 215-C, Plat Records of Bell County, Texas, and Lot One A (1A), Block One (1), Replat of Lot 4, Block B, Highland Oaks Estates, Section One, and Lots 1 & 5, Block 10, Highland Oaks Estates, Section Three, an addition to the City Of Harker Heights, according to the Plat of Record in Cabinet C, Slide 339-C, Plat Records of Bell County, Texas, generally located at 703 W. Knights Way (W. FM 2410), Harker Heights, Bell County, Texas. Joseph Molis, Planning and Development Director, made the presentation. Barry Hinshaw, representative, was present to represent the request.  Blomquist made the motion to approve an ordinance granting a Conditional Use Permit (CUP) to allow uses associated with B-1 Zoning District. This permit is subject to the following conditions:

1. The property may be used only as (a) a real estate office; or (b) a professional office for doctors, dentists, lawyers, architects, certified public accountants, or registered engineers and surveyors. Any such office may include customary staff associated with such offices or professions.
2. A six foot (6') masonry fence shall be constructed along the rear property boundary. Fences along neighboring properties to either side of the site must be constructed of cedar or pressure treated materials, with support posts located eight feet on center, or other materials and designs as may be approved by the Director of Planning and Development. Additionally, all screening requirements must be completed prior to receiving a Certificate of Occupancy on the property.
3. The architectural style and appearance of the structure shall maintain a residential character.
4. Parking in the rear yard must consist of a permanent, all-weather surface, or decomposed granite. All patrons must park in the designated parking areas. Parking for patrons will not be allowed on the street or on landscaped areas.
5. Any trees removed from the property shall be replaced onsite by trees of a similar type.
6. All exterior lighting shall be fully shielded and down-lit to prevent light trespass onto surrounding properties.
7. Signage shall consist of either:
a. One (1) wall sign not to exceed twenty four (24) square feet may be placed on the front façade wall parallel to the surface to which it is attached. If illuminated, signage must be externally illuminated, shielded and down lit. In addition, one monument sign listed below may be permitted on site.
b. One (1) Monument sign out of the public right-of-way shall be permitted. The sign shall not exceed thirty (30) square feet in area and may not be more than six (6’) feet in height. Signage must be externally illuminated, shielded and down lit.
8. No box or channel letter type signs are permitted.
9. No outside storage will be allowed.
10. Site plan approval is required prior to the issuance of any development permits, including clearing, grading and Storm Water Pollution Prevention Plans (SWPPP). Site Plans may be approved by the Director or Planning and Development upon determination that the proposal complies with the requirements of Ordinance 2013-16 (Development Overlay District No. 1).
11. The site will comply with all other regulations and requirements within the Harker Heights Code of Ordinances.
Seconded by McCann. The affidavit filed by Councilmember Reider indicates that he has a statutory conflict due to having a substantial interest in a business that stands to realize a special economic effect so he is disqualified from the vote. Thus four (4) members is the number that are qualified here in voting and is considered being the entire Council in this case and so to overturn the decision of the Planning and Zoning Commission, ¾ of four (4)  and not ¾ of five (5) Council members or a vote of three (3) to approve is needed. The motion was approved 3-1 with Fountain against.

At 6:20 p.m. Councilmember John Reider returned to the meeting.

At 6:20 p.m. Mayor Smith called for a ten (10) minute break.

Mayor Smith reconvened the meeting at 6:31 p.m.

New Business:

1. Council discussed and considered approving a request for alcohol services for the 3rd Annual Puerto Rican Heritage Festival at 2410 Community Park on Saturday, September 7, 2019. The applicant withdrew the request. No action taken.

2. Council discussed and considered approving an ordinance of the City of Harker Heights, Texas, amending the Parks and Recreation Activenet Online Service Charges in the Fiscal Year 2018-2019 Fee Schedule to increase fees by 4%. Jeff Achee, Parks and Recreation Director, made the presentation. Fountain made the motion to approve. Seconded by Reider. All in favor. Motion approved 5-0.

3. Council discussed and considered approving a resolution awarding a contract for the Rattlesnake Road 6-Inch Waterline Replacement Project in the amount of $199,990.00 to TTG Utilities, LP. Mark Hyde, Public Works Director, made the presentation. Reider made the motion to approve. Seconded by Blomquist. All in favor. Motion approved 5-0.

Leona Clay, Human Resource Director, introduced the City Consultant, Burke Sunday and Sara Davis, Life and Health Insurance Counselors at Gallagher Benefit Services who made the presentation. Blomquist made the motion to approve a resolution of the City of Harker Heights Employee Benefits Trust awarding contracts for the City of Harker Heights Employee Benefits Trust group medical plan to United Health Care, Superior Vision for vision benefits, Lincoln Financial for dental benefits, life insurance, AD&D, and long term disability benefits and authorizing the City Manager to enter into such contracts on behalf of the City and the Employee Benefits Trust. Councilmember Fountain stated that she attended the Memorial Day Ceremony at the Central Texas State Veterans Cemetery in Harker Heights on Monday, May 27th and the VFW Veteran’s Ceremony on Sunday, May 25th.  Fountain thanked Nichole Broemer, Activities Center & Events Manager, for putting on the City of Harker Heights Memorial Day Parade. Fountain stated that she attended Congressman Carter’s Women’s Advisory Council Meeting in which he introduced two the following two bills: the Military Spouses Employment Act to provide employers a new tax credit to hire qualified military spouses and the Military Base Operations and Infrastructure Innovative Management Act to establish a pilot program to promote the use of technologies on military installations. The employed technology will be aimed at improving the performance of infrastructure systems, communications, safety, energy use, time management, and base operations services.

1. Council discussed and considered approving a resolution authorizing the City Manager to sign a Memorandum of Understanding between the City of Harker Heights, Texas, and the Bell County Public Health District to provide Mass Prophylaxis/Vaccine Dispensing Locations. 3. Council discussed and considered approving a resolution of the City of Harker Heights, Texas, authorizing the Membership and approval of an Interlocal Participation Agreement with the GoodBuy Purchasing Cooperative and authorize the City Manager to sign the contract on behalf of the City. 4. Council discussed and considered approving a resolution of the City of Harker Heights, Texas, finding that Oncor Electric Delivery Company LLC’s application for approval to amend its Distribution Cost Recovery Factor pursuant to 16 Texas Administration Code § 25.243 to increase Distribution Rates within the City should be denied; finding that the City’s reasonable Rate Case Expenses shall be reimbursed by the Company; finding that the Meeting at which this resolution is passed is open to the public as required by law; requiring notice of this resolution to the Company and Legal Counsel. Mayoral Proclamations and Presentations:

1. The Mayor presented a proclamation to Lisa Youngblood, Library Director, proclaiming April 7-13, 2019, as “National Library Week”.

2. Fire Chief Sims presented the proceeds in the amount of $3,660.00 from the 2018 Fire Department Calendar Sales to Jessica Giese, Pet Adoption Manager, for the Pet Adoption Center (PAC).

Public Hearings:
           
1. Council conducted a public hearing on the need to continue sections 130.20 through 130.25 of the Harker Heights Code of Ordinances defining a Curfew for Minors in the City of Harker Heights, and discuss and consider whether such subchapter will be continued, abolished or modified. Phil Gadd, Police Chief, made the presentation. Schiffman made the motion to approve. Seconded by Fountain. All in favor. Motion approved 5-0.

New Business:

1. Council discussed and considered approving a resolution awarding a contract for the Carl Levin New Restroom Facility Project in the amount of $210,000.00 to Holy Contractors, LLC. Jeff Achee, Parks and Recreation Director, made the presentation. Schiffman made the motion to approve. Seconded by Nicholas. All in favor. Motion approved 5-0.

2. Council discussed and considered approving a resolution awarding a contract for the Carl Levin New Restroom Facility Utility Extensions Project in the amount of $141,036.86 to Holy Contractors, LLC. Jeff Achee, Parks and Recreation Director, made the presentation. Nicholas made the motion to approve. Seconded by Fountain. All in favor. Motion approved 5-0.

Councilmember Schiffman thanked Mayor Smith for representing the City and City Council at the Phantom Honors Award and Farewell Ceremony in Honor of Major General Felix G. Gedney, Deputy to the Commanding General, III Corps.

Mayor Pro-tem Fountain thanked the Parks and Recreation Director for getting and having put in the new restroom facility at the Carl Levin Park.

Councilmember Schiffman thanked Fire Chief Sims and his department for the fundraiser they did for the Pet Adoption Center (PAC).

Mayor Smith stated that he attended the following events:
• On March 27th, and 28th he was in Austin to attend the National Water Now Alliance Summit.
• On March 29th, he attended the VFW 3892 National Veteran’s Day Ceremony.
• On March 29th, he attended the Tactical Air Control Party Association 24 hour challenge and 5k run at Carl Levin Park.
• On March 30th, he, Mayor Pro-tem Fountain and Councilmember Nicholas attended the Sociedad Cultural Hispanoamericana 43rd Anniversary Banquet.
• On April 3rd, he, Mayor Pro-tem Fountain and Councilmembers Schiffman and Nicholas attended the Phantom Honors Award and Farewell Ceremony in Honor of Major General Felix G. Gedney, Deputy to the Commanding General, III Corps.
• On April 5th, he attended the Educated Angels Gala at Club Hood.
• On April 8th, he along with David Mitchell, City Manager and Jerry Bark, Public Relations Director, were in Austin to give testimony to the House Appropriations Committee on Representative Buckley’s House Bill 634 regarding 100% Disabled Veteran’s Property Tax Exemption.

Alberta Barrett, Finance Director, made the presentation. Reider made the motion to approve. Seconded by Nicholas. All in favor. Motion approved 5-0.

2. Council discussed and considered approving a resolution awarding a contract for a concession agreement to Mama’s Soul Catering and Concessions, LLC for one year, with the City having two successive one-year options to renew for a maximum combined term of three years, and authorizing the City Manager to enter such contract on behalf of the City. Jeff Achee, Parks and Recreation Director, made the presentation. Blomquist made the motion to approve adopting a resolution awarding a contract for a concession agreement to Mama’ Soul for one year, with the City having two successive one-year options to renew for a maximum term of three years, and authorizing the City Manager to enter into such contract on behalf of the City. Seconded by Reider.  All in favor. Motion approved 5-0.

At 5:15 p.m. Mayor Spencer H. Smith filed an Affidavit for Conflict of Interest for Public Hearing item number one and left the meeting.  Mayor Pro-tem Jackeline Soriano Fountain took the Mayor’s seat.

1. Council conducted a public hearing to discuss and consider approving an ordinance granting a Conditional Use Permit (CUP) to allow an accessory dwelling unit on property described as part of Lot Eight (8) and all of Lot Nine (9) and Lot Ten (10), Block Four (4), Hidden Valley Estates, an addition in Bell County, Texas, recorded in Cabinet A, Slide 212-A, Plat Records of Bell County, Texas, generally located at 2223 Fuller Lane, Harker Heights, Bell County, Texas. Joseph Molis, Planning and Development Director, made the presentation. Tara K. Ortiz was present to represent the request. Schiffman made the motion to grant a Conditional Use Permit (CUP) for a period of six (6) months after which the structure/camper will be removed from the property permanently. Seconded by Reider. All in favor. Motion approved 4-0.

Items from Council:

Councilmember Blomquist stated that on March 19th he attended the Veteran’s Council meeting at the Rec Center with the Parks and Recreation Department representatives. They discussed the 3rd Cavalry Regiment Welcome Home Celebration, and discussed the Memorial Day Parade preparations.

Mayor Pro-tem Soriano Fountain stated that the 3rd Cavalry Regiment Welcome Home Celebration was, as stated by the Commander of the Unit, by far a first class event. Fountain stated that it is great to be a part of the City and see everyone come together and make our soldiers welcome.

Mayor Smith stated that he along with Mayor Pro-tem Fountain and Councilmember Nicholas attended the Fort Hood Area Habitat for Humanity Gala over in Temple.  The Fort Hood Area Habitat for Humanity attempted to get a club through the local universities and colleges but had no takers, but had a group from the Harker Heights High School and only the Harker Heights High School Club was the only one in the area.

Mayor Smith stated that he attended the following events:
• Attended the 100th Anniversary for the American Legion with the Harker Heights American Legion Post.
• Participated in the Texas Mayors of Military Communities Conference Call with the Focus Advocacy Group working on Military issues with the 86th Legislature.
• Attended along with Councilmembers Schiffman, Blomquist, Nicholas and Mayor Pro-tem Soriano Fountain the Operational Test Command (OTC), Command Team Luncheon Update of what is going on at West Fort Hood.
• Attended the 3rd Cavalry Regiment Welcome Home Celebration.
• Attended along with Councilmember Schiffman and Mayor Pro-tem Soriano Fountain, the III Corps Distinguished Service Cross Ceremony at the 1st Cavalry Division Headquarters.
• Attended the No Host dinner with members of the Fort Hood Staff Delegation in Copperas Cove.

Councilmember Schiffman stated his appreciation to Staff and Jerry Bark, Director of Public Relations for the Legislature Bills of interest list, it is very helpful and of great utility.

Councilmember Blomquist thanked Jeff Achee, Parks and Recreation Director, City Staff, and the City Manager for signing the document that is on its way to the Corps of Engineers regarding the City’s request for Dana Peak Park.  It has been a hugh undertaking and this takes the City one step closer to seeing Dana Peak Park as a new park for the City of Harker Heights.

Reports of Advisory Boards & Commissions:

Councilmember Blomquist stated that he attended the Bell County Public Health District Quarterly Meeting and the following important issues were discussed:
• There has been one confirmed case of measles in West Bell County, one in Denton and one in San Antonio, and several suspected cases that were negative.
• Dr. Janice Smith gave an update on the Temple and Killeen Clinics and stated that they are looking at hiring another Nurse Practitioner to insure that the case loads are being met.
• Cathy Brem gave an update on the Mobile Pod Exercise.
• House Bill 749 dealing with Tobacco 21 Legislation which would increase the age to 21 for tobacco use and would include e-cigarettes. They discussed asking for Cities to support the Legislation.

Councilmember Schiffman stated at the Central Texas Council of Governments meeting, they were informed that texting to 911 is now active and will get the same response as calling 911.

Items from Council:

Mayor Smith stated that he attended the Harker Heights Volunteer Reception and Award Ceremony and that it was a good event. Mayor Smith commended Lisa Youngblood, Library Director and her staff for all of their work on the event. Mayor Smith stated that he attended the following events:
• Meadows Elementary Read across America for celebrating Dr. Seuss
• Harker Heights High School Football boot camp at 3rd Corps versus Killeen High School event
• Attended and threw out the first pitch at the Harker Heights boys’ Varsity Baseball game
• Harker Heights Chamber of Commerce Town Hall meeting with District 54 Representative Dr. Buckley.

Mayor Pro-tem Fountain stated that she attended the Meadows Elementary Dr. Seuss reading and the First Dominican Parade.

3. Council discussed and considered approving a resolution authorizing the City’s participation in a Homeland Security Grant Program administered by the Office of the Governor, for funding the purchase of One Unmanned Aircraft System (Drone). Schiffman made the motion to approve a resolution authorizing the City’s participation in a Homeland Security Grant program administered by the Office of the Governor, for funding the purchase of one Unmanned Aircraft System (Drone) and training. 4. Council discussed and considered approving a  resolution authorizing the City’s participation in the Grant Program administered by the Firehouse Subs Public Safety Foundation Grants, LRAD Corporation, for funding the purchase of 31 Individual First Aid Kits (IFAKS), 5 Mass Casualty Kits (25 Individual Kits) and 25 Vehicle IFAKS. 5. Council discussed and considered approving a resolution authorizing the City’s participation in the Homeland Security Grants Division Program for funding of the Crisis Response System for the Tactical and Negotiations Team. Phil Gadd, Police Chief, made the presentation. Schiffman made the motion to approve the resolution authorizing the City’s application for a grant through the Homeland Security Grants Division Program in the amount of $19,999.95 with no cash match required. Seconded by Nicholas. All in favor. Motion approved 5-0.

6. Council discussed and considered approving a resolution authorizing the City’s participation in the General Victim Assistance Direct Services Program Grant for funding of the Healthy Homes Program. Phil Gadd, Police Chief, made the presentation. Blomquist made the motion to approve the resolution authorizing the City’s application for a grant through the General Victims Assistance Direct Services Program in the amount of $63,090.00, including in-kind match and no cash match. Items from Council:

Councilmember Blomquist stated that on January 25th, he and the Mayor attended the III Corps monthly Retirement Ceremony where nine (9) soldiers and their families were honored for their service to our country.

Mayor pro-tem Fountain, on behalf of the Fountain family, thanked everyone for their prayers and thoughts during the time of loss in her family.

Mayor Smith stated that on January 23rd he attended the Greater Killeen Chamber of Commerce Public Policy Council luncheon held at Central Texas College where new County Judge David Blackburn and Killeen Mayor Segarra spoke about some items that were germane to the City of Harker Heights.  Mayor Smith also attended the Central Texas Council of Governments (CTCOG) Annual Membership meeting at the Expo and was able to have contact with people as the City participates with the CTCOG and the Killeen-Temple Metropolitan Planning Organization for transportation issues. On January 28th, he participated in a teleconference with a group called Focus Advocacy and a group the City is a part of which is called the Texas Mayors of Military Communities, which is a group that lobbies for issues that are germane to the City as a Military community and some of the issues that are very important to the City as far as the City’s #1 priority on trying to get assistance with property tax issues.  Mayor Smith attended the Harker Heights Chamber of Commerce Awards Banquet and stated the Fireman and Police Officer of the Year Award were well deserves and shows to the community the outstanding work being done by those departments.  He, along with Councilmember Blomquist, attended the Planning and Zoning Commission meeting on January 30th, and commended the Board for all the work they put into it.  Mayor Smith attended the Hood Hero’s Banquet on February 5th, the Harker Heights Chamber of Commerce Killeen Independent School District Luncheon featuring Dr. John Craft on February 6th, the Texas A&M Central Texas Sweet Success Gala for Lemonade Day on February 7th, and the Harker Heights Kiwanis Pancake Supper at the Harker Heights Elementary School on February 9th.

1. Council discussed and considered adopting an ordinance authorizing the issuance and sale of City Of Harker Heights, Texas, Combination Tax and Revenue Certificates of Obligation, Series 2019, in a maximum aggregate principal amount of $4,000,000; levying a tax in payment thereof; authorizing the sale of said certificates of obligation; authorizing the execution and delivery of a paying agent/registrar agreement; approving the official statement; finding and determining that the meeting at which this ordinance is passed is open to the public as required by law; and enacting other provisions relating thereto. Alberta Barrett, Finance Director, made the presentation. The City’s Financial Advisor, Garry Kimball of Specialized Public Finance was present to review the rates and process for funding. Schiffman the motion to approve. Seconded by Reider. All in favor. Motion approved 4-0.

2. Council discussed and considered approving a resolution authorizing the City Manager to negotiate and sign a Design-Build Contract with Hill and Wilkinson General Contractors for the Fire Station #2 remodel, renovation and addition. Paul Sims, Fire Chief, made the presentation. Blomquist made the motion to approve. Seconded by Nicholas. All in favor. Motion approved 4-0.

3. Council discussed and considered approving an ordinance granting a variance of Harker Heights Code of Ordinances §112.02 to allow the sale of beer and other alcoholic beverages within 300 feet of a church on property located at 1350 E. FM 2410, as permitted by Texas Alcoholic Beverage Commission (TABC) Section 109.33(E). Joseph Molis, Planning and Development Director, made the presentation. John Vela was present to represent the request.  Nicholas made the motion to approve. Seconded by Reider. All in favor. Motion approved 4-0.

4. Council discussed and considered approving a request for alcohol services for the Harker Heights Chamber of Commerce “Mug Run Series” Events scheduled for July 6, September 14, and December 14, 2019, at the 2410 Community Park. Jeff Achee, Parks and Recreation Director, made the presentation. Blomquist made the motion to approve a request for alcohol services for the Harker Heights Chamber of Commerce “Mug Run” Series at the 2410 Community Park for July 6, September 7, and December 14.  Seconded by Schiffman. All in favor. Motion approved 4-0.

5. Council discussed and considered approving a request for Alcohol Services for the Harker Heights Chamber of Commerce “Central Texas Food, Wine & Brew Festival” at 2410 Community Park on Saturday, September 14, 2019. Jeff Achee, Parks and Recreation Director, made the presentation. Reider made the motion to approve. Seconded by Schiffman. All in favor. Motion approved 4-0.

6. Council discussed and considered approving a resolution awarding a contract for the Water Storage Tank Rehabilitation Project in the amount of $634,625.00 to A&M Construction and Utilities, Inc. Mark Hyde, Public Works Director, made the presentation. Schiffman made the motion to approve. Seconded by Nicholas. All in favor. Motion passed 4-0.

7. Council discussed and considered the appointment of a Councilmember to the Hill Country Transit Authority Board for a four year term ending January 7, 2023. David Mitchell, City Manager, made the presentation. Schiffman made the motion to appoint Council member Reider to the Hill Country Transit Authority Board for a four year term ending January 7, 2023. Seconded by Blomquist. All in favor. Motion approved 4-0.

Items from Council:

Mayor Smith stated that he attended the Doctor Martin Luther King, Jr. Day breakfast and program at the Harker Heights Community Church and he attended the Fort Hood III Corps. Shoemaker Center Dedication.

Councilmember Blomquist thanked Fire Chief Sims for coordinating with the Corps of Engineers and the Forestry Service in starting the fire break clearing along the southern border of Harker Heights between the Corps of Engineers’ property and Harker Heights.

Councilmember Schiffman stated that he was contacted by a citizen reporting a water leak. He passed the information to the Public Works Department and about 20 minutes later got a call from Mark Hyde, Public Works Director, informing him that the situation had been investigated and handled.  Mr. Schiffman stated he appreciates the Public Works continued real responsive support of the constituents.

2. Mr. Howard Arey, 2027 Sandy Point, Harker Heights, Texas 76548, gave a short presentation regarding solar regulations within the City Limits of the City of Harker Heights. No action taken.

New Business:

1. Council discussed and considered approving a resolution authorizing the City’s participation in the Grant Program provided by the Texas Department of Transportation, Selective Traffic Enforcement Program Grant, for funding the salaries of officers to conduct direct traffic enforcement in identified traffic problem areas. Phil Gadd, Police Chief, made the presentation. Blomquist made the motion to approve. Seconded by Nicholas. All in favor. Motion approved 4-0.

2. Council discussed and considered approving a resolution of the City of Harker Heights, Texas, in support of Bell County Water Control & Improvement District Number One’s (WCID #1)  efforts to expand the WCID #1 District Boundary and expand and modify its Board representation to include all of its wholesale customers. David Mitchell, City Manager, made the presentation. Schiffman made the motion to approve a resolution of the City of Harker Heights, Texas in support of the Bell County Water Control & Improvement District Number One’s (WCID #1) efforts to expand the WCID #1 District Boundary and forfeit its taxing authority in order to modify its Board representation to include all of its wholesale customers. Seconded by Reider. All in favor. Motion approved 4-0.

3. Discuss and consider approving a resolution awarding a contract for the Wastewater Interceptor Line “A” Project in the amount of $574,482.10 to Bruce Flanigan Construction, Inc. Mark Hyde, Public Works Director, made the presentation. Reider made the motion to approve. Seconded by Schiffman. All in favor. Motion approved 4-0.

Councilmember Reider thanked the Mayor, Councilmembers Blomquist and Schiffman for attending his father’s funeral and thanked the Harker Heights Pet Adoption Center for accepting donations, which he requested in lieu of flowers, for the Pet Adoption Center in his father’s name.

Mayor Smith stated that on Saturday he attended the visitation at Crawford-Bowers Copperas Cove, for Mayor Frank Seffrood and expressed condolences from the City of Harker Heights to his wife Rita Seffrood.
